HERKIMER — Three men have been convicted and sentenced to state prison for attacking another man on South Main Street in Herkimer, according to the Herkimer Police Department.

Police said the three men — Rafael Prestol, 43, of Herkimer; Chester Talarico, 38, of Ilion and James Hurst, 30, of Hamilton in Madison County — attacked a 43-year-old man in the 200 block of S. Main Street in Herkimer around 10:30 a.m. Oct. 17, 2021.

Police said the victim was left bleeding from the neck and he was treated at a local hospital.

Following an investigation, police said all three men were identified and taken into custody in November 2021.

As a result:

  • Talarico eventually pleaded guilty in court to second-degree burglary and he was sentenced to five years in prison, with five years of post-release supervision, authorities said.
  • Prestol was found guilty by a jury in November 2022 on two counts of first-degree burglary, and he was sentenced earlier this month to 20 years in state prison, police said.
  • Hurst was found guilty by a jury in December 2022 on two counts of first-degree burglary and one count of second-degree assault, authorities stated. Hurst was sentenced earlier this month to 20 years in state prison.
