WHITESTOWN — A registered sex offender was charged this week with failing to update his address and provide a recent picture to the New York State Sex Offender Registry, according to the Oneida County Child Advocacy Center.

Investigators said David Giacona, age 40, of Whitestown, was taken into custody on Thursday for failing to maintain his obligations as a Level 3 sex offender. Authorities said Giacona did not provide a current photograph of himself to his local law enforcement agency, and failed to confirm his address within the required 90-day window.

Giacona was charged with one count each of failure to provide an updated photo and failure to verify address, both felonies, authorities said. He is scheduled to appear in court.

According to state records, Giacona was previously convicted in 2004 of second-degree rape involving a 14-year-old girl. He was sentenced to two to four years in state prison. 

According to the advocacy center, Giacona was also previously arrested in April for subjecting a girl under the age of 17 to sexual contact at a residence in Whitestown in the summer of 2020. He was charged with third-degree sexual abuse and endangering the welfare of a child, authorities said. That case remains ongoing in court.
