Murder trial for Taberg homicide moved to December

UTICA — The trial date for the Taberg brothers accused of attacking and killing their third brother has been moved to early December.

A new tentative trial date has been set for Dec. 5 for Matthew and Micheal Westcott, both charged in the death of their other brother, James Westcott. Both brothers are also scheduled to appear in court on Nov. 28 for a final pre-trial hearing before Oneida County Court Judge Robert L. Bauer. 

The dual trial had been scheduled to begin on Monday, Sept. 19. Court officials said the trial was pushed back to allow the prosecution and defense to continue their pre-trial investigations. 

According to state police, Matthew Westcott shot and killed James Westcott at their Route 69 home in the Town of Annsville on Sept. 17, 2021. Shortly after the shooting, troopers said Micheal Westcott took a knife and stabbed the dying James multiple times in the back of the head.

Matthew Westcott is charged with second-degree murder. Micheal Westcott is charged with attempted second-degree murder and first-degree assault.
