House arrest in Vogel Park snowmobile crash

A snowmobile crash into Vogel Park on North George Street early last year sent one man to the hospital for several weeks with a bad head injury.

It has now also resulted in six months house arrest for the operator.

Jeffrey Badolato, 37, of 1768 N. George St., was sentenced by County Court Judge Michael L. Dwyer July 26 to six months house arrest, five years probation and was ordered to pay $375 in court fees on a charge of second-degree vehicular assault.

Police said at 9:41 p.m. Feb. 19, 2011, Badolato and passenger Julius J. Deraway, age 40, were riding southbound on North George Street heading towards the circle-shaped Vogel Park. Police said Badolato rode his 1989 Polaris snowmobile into the park and over a snow embankment, launching the sled into the air. The snowmobile was traveling at least 36 mph, police stated.

The snowmobile flew 41 feet across the park. While it was airborne, police said one of the skis hit a tree, causing the sled to tilt. Both Badolato and Deraway were then thrown off the sled, and authorities said Deraway crashed through a park bench. He was not wearing a helmet, and was seriously injured.

The indictment said Badolato registered a blood alcohol content of 0.11 percent, and he was also high on marijuana at the time of the crash.

Also in City Court:

¿ Stephen LaClaire, 20, of 108 Weaver Road, Dolgeville, was sentenced by Judge Barry M. Donalty July 31 to two years in state prison, followed by five years of post-release supervision, on a charge of second-degree rape.

Authorities said LaClaire had sex with a child less than 15-years-old when he lived in Rome last fall. He was taken into custody on March 23 after the victim came forward.

¿ Shawn M. Tennant, 24, of 3537 Oswego Road, and Seth R. Desjardins, 20, both of 2796 Poppleton Road, Durhamville, both pleaded guilty before Judge Dwyer July 30 to attempted second-degree burglary. Their cases were adjourned for sentencing to Sept. 20. Co-defendent Edward J. Williamson, 38, also of Verona, is scheduled to appear on Aug. 6.

Police said at 7:46 p.m. June 5, cousins Tennant and Desjardins were caught stealing extension cords in a garage on Amherst Drive in Rome. Police said Williamson, Desjardins’ step-father, waited nearby in a pickup truck.

¿ Terrance R. Witherspoon, 21, of 232 Park Drive Manor, pleaded guilty before Judge Dwyer July 30 to one count each of first and second-degree burglary. His case was adjourned for sentencing to Sept. 18.

The indictment said in April, Witherspoon was found with a stolen laptop in Rome. Then on May 12, the indictment said Witherspoon broke into a residence on the Parkway in Rome, where he stole a different laptop, as well as jewelry, two video game consoles and several games. On May 17, authorities said Witherspoon used a knife during a break-in at Park Drive Manor II. The indictment said Witherspoon cut through a screen door and stolen a set of keys from a woman, then was found with those same keys in Rome on May 23.

¿ Dustin A. Becraft, 17, of 830 Croton St., pleaded guilty before Judge Donalty July 31 to third-degree burglary. His sentencing was adjourned until Sept. 13.

Authorities said at 11 p.m. April 30, Becraft stole a security camera after breaking into the American Metal Stamping and Spinning facility in Rome.

¿ John Abbott, 48, of 6220 Bartlett Road, Westmoreland, pleaded guilty before Judge Dwyer July 26 to third-degree burglary. His case was adjourned for sentencing to Sept. 12.

According to court documents, Abbott broke into a residence on Lowell Road in Westmoreland to commit a larceny on March 6.

¿ James E. Willson, 34, of 1722 California Road, Camden, was sentenced by Judge Dwyer July 26 to four years in prison, followed by two years of post-release supervision, and was ordered to pay $375 in court fees on a charge of third-degree possession of a controlled substance.

The indictment said on Jan. 18, Willson was found with methamphetamine in Rome.
