Vogel Park snowmobiler denies charges

A 37-year-old man who law enforcers said was both intoxicated and high on marijuana when his snowmobile crashed into Vogel Park has denied his charges in County Court.

The crash also seriously injured a passenger who spent several weeks in the hospital.

Jeffrey Badolato, of 1768 N. George St., pleaded not guilty before Judge Michael L. Dwyer April 20 to one count each of second-degree vehicular assault, snowmobiling under the influence of drugs, unlawful possession of marijuana and two counts of snowmobiling while intoxicated. His case was adjourned for report to May 10.

Police said at 9:41 p.m. Feb. 19, 2011, Badolato and passenger Julius J. Deraway, age 40, were riding southbound on North George Street heading towards the circle-shaped Vogel Park. Police said Badolato rode his 1989 Polaris snowmobile into the park and over a snow embankment, launching the sled into the air. The snowmobile was traveling at least 36 mph, police stated.

The snowmobile flew 41 feet across the park. While it was airborne, police said one of the skis hit a tree, causing the sled to tilt. Both Badolato and Deraway were then thrown off the sled, and authorities said Deraway crashed through a park bench. He was not wearing a helmet, and was seriously injured.

The indictment said Badolato registered a blood alcohol content of 0.11 percent, and he was also high on marijuana at the time of the crash.

Also in County Court:

¿ Lee Brown, 42, of 9516 Stedman Road, Lee Center, pleaded guilty before Judge Barry M. Donalty April 25 to second-degree unlawful surveillance. His case was adjourned for sentencing to June 13.

According to court documents, Brown video-taped another man without his permission and knowledge in Lee on July 6, 2009.

¿ Travis Maurine, 25, of Stafford Avenue, Waterville, pleaded not guilty April 20 to one count each of second-degree vehicular assault, second and third-degree assault, driving while intoxicated and failure to keep right. His case was adjourned to May 3.

Authorities said at 10:30 p.m. Dec. 18, 2010, Maurine was driving drunk on Route 233 in Rome when his vehicle collided head-on with another vehicle driven by Rachel Inman. Authorities said Maurine’s passenger, Kate Rizzo, suffered a severe head injury and brain trauma. Maurine is a firefighter with the Utica Fire Department.

¿ Albert Duffy, 49, of 16 W. Park Row, Clinton, pleaded not guilty before Judge Dwyer April 19 to one count of planting a fake bomb. His case was adjourned for report to May 3.

Authorities said on Feb. 21, Duffy made a fake bomb out of road flares, clear tubing and wire, and left the device and several ominous handwritten notes in his room at the Scottish Inn on Genesee Street in Utica.

¿ Renee Harris, 48, of 418 S. James St., was sentenced by Judge Dwyer April 19 to 60 days house arrest, three years probation and was ordered to pay $3,411 in restitution on a charge of attempted fourth-degree grand larceny.

The indictment said between September 2009 and May 2010, Harris received $4,466 in food stamps from the county Department of Social Services to which she was not entitled. The indictment said Harris also received money for daycare services that were not performed between April and May 2010.

¿ Kimberly S. Zammiello, 50, of 18 Tracey St., Whitesboro, pleaded not guilty before Judge Dwyer April 19 to one count of third-degree grand larceny. Her case was adjourned for report to April 30.

The indictment siad between April 2010 and April 2011, Zammiello received more than $3,000 in unemployment benefits from the state Department of Labor.

¿ April Blanchard, 33, of 3275 Pond Hill Road, Annsville, pleaded guilty before Judge Dwyer April 20 to fourth-degree grand larceny. Her case was adjourned for sentencing to June 8.

Authorities said between March 2009 and January 2010, Blanchard received $5,005 in food stamps from the county Department of Social Services, despite the fact that her husband was gainfully employed. Authorities said Blanchard repeatedly failed to notify Social Services each time she applied over those months.

¿ Randy C. Harrington, 24, of 242 Park Drive Manor, was sentenced by Judge Dwyer April 17 to one to three years in state prison on a probation violation. Harrington had been on probation from a burglary conviction from 2007.

Authorities said Harrington violated his probation when he was arrested for domestic abuse in October in Rome. He was recently sentenced in Rome City Court to six months in county jail for the abuse against his 22-year-old girlfriend.
