Felony filed in choking case

A 24-year-old man has been charged with a felony after law enforcers said he snuck into his ex-companion’s South Crescent Drive home early one morning and choked him.

Police said Justin R. Miller, of 608 Parkhurst Road, Middleville in Herkimer County, telephoned his ex-companion multiple times and sent several text messages between 12:30 and 2:30 p.m. on March 18. Police said Miller had been court-ordered to leave his ex-companion alone.

Then at 4:50 a.m. March 25, police said Miller snuck into the man’s apartment on South Crescent Drive while his ex was sleeping. The man woke up to find Miller, and then police said a verbal argument turned physical when Miller started choking the man and bit him on the arm. Miller fled the scene and was picked up on an arrest warrant on Friday.

Miller is charged with one count each of felony first and misdemeanor second-degree contempt, as well as second-degree trespass and second-degree harassment, police stated. He was arraigned before City Court Judge Daniel C. Wilson Friday, and was sent to county jail on $5,000 cash bail or bond. His case was adjourned to April 4.
